Terms of Use/ Service Agreement

Welcome to Shagun Matrimonial. In order to use Shagun Matrimonial services, you must register as a member of Shagun Matrimonial and agree to these Terms of Use ("Agreement"). If you wish tobecome a Member and make use of the Shagun Matrimonial services ("Service"), read these Terms of Use and follow the instructions of the counselor for the Registration process. ThisAgreement sets out the legally binding terms for your membership. Shagun Matrimonial may modify this Agreement from time to time, effective upon notice to you as a Member

Eligibility

You must be of legal marriageable age or over as per the Indian laws, to register as a member of Shagun Matrimonial or use its services. By registering at Shagun Matrimonial, you represent and warrant that you are of legal marriageable age and that you have the right, authority, and capacity to enter into this Agreement and to abide by all of the terms andconditions of this Agreement.

Term

This Agreement will remain in full force and effect while you use the Services and/or are a Member of Shagun Matrimonial. You may terminate your membership at any time, forany reason by writing to Shagun Matrimonial. Shagun Matrimonial may terminate your access to the Services and/or your membership at any time and for any reason effective upon sending notice to you at the e-mail address you provide in your Bio-data Form or such other address as you may later provide to Shagun Matrimonial. Please note that we do not entertain refund and cancellation in any circumstances. Even after this Agreement is terminated, certain provisions of this agreement will remain in effect including sections 4,5,7,9 -14.

Non-Commercial Use by Members

The Shagun Matrimonial service is for the personal use of individual members only, and is not to be used in connection with any commercial activities.Organizations,companies, and/or businesses are not eligible to become Members of Shagun Matrimonial and are not authorized to use the Shagun Matrimonial Service for any purpose. Illegal and/orunauthorized uses of the Services will be investigated, and appropriate legal action will be taken, including without limitation, civil, criminal, and injunctive redress.

Other Terms of Use by Members

Shagun Matrimonial member(s) may not engage in advertising to, or solicitation of, other Members to buy or sell any products or services through the Service. You will not transmit any chain letters or junkemail or Spam mail to other Shagun Matrimonial members. Although Shagun Matrimonial cannot monitor the conduct of its Members, it is also a violation of these rules to use any informationobtained from the Service in order to harass, abuse, or harm another person, or in order to contact, advertise to, solicit, or sell to any Member any product or service without theirprior explicit consent. In order to protect Shagun Matrimonial and/or our members from any abuse / misuse or unauthorized use, Shagun Matrimonial reserves the right to restrict the number of Bio-data’s which a member may get of other members which Shagun Matrimonial deems appropriate in its sole discretion.

Proprietary Rights in Content on Shagun Matrimonial.

Shagun Matrimonial owns and retains other proprietary rights in the Shagun Matrimonial service. The Service contains the copyrighted material, trademarks, and other proprietary information of Shagun Matrimonial, and its licensors. Except for that information which is in the public domain or for which you have been specifically given permission by Shagun Matrimonial, you may not copy, modify, publish, transmit, distribute, perform, display, or sell any such proprietary information. Any breach of this term shall entitle Shagun Matrimonial to forthwith terminate your membership without any liability to Shagun Matrimonial.

Content Posted on the database

You understand and agree that Shagun Matrimonial may delete any content, messages, photos or profiles (collectively, "Content") that in the sole judgment of Shagun Matrimonial violate the Terms of Use or the Service or which might be offensive, illegal, or that might violate the rights, harm, or threaten the safety of Shagun Matrimonial and/or its Members or otherwise if Shagun Matrimonial (in its sole discretion) deems it fit and necessary. Shagun Matrimonial is not obliged to give any reason for such deletion.

1. You are solely responsible for the Content that you fill-in or display (hereinafter, "post") on the Shagun Matrimonial website/database, or transmit to other Shagun Matrimonial Members. Shagun Matrimonial reserves the right (but is under no obligation) to verify the authenticity of Content posted on the site. In exercising this right, Shagun Matrimonial may ask you to provide any documentary or other form of evidence supporting the Content you post on the site. If you fail to produce such evidence or if the evidence is not acceptable to Shagun Matrimonial in its sole discretion, Shagun Matrimonial may, in its sole discretion, terminate your membership without any refund.
2. By giving Content to Shagun Matrimonial, you hereby grant, and represent and warrant that you have the right to grant, to Shagun Matrimonial, and other Shagun Matrimonial Members, an irrevocable, perpetual, non-exclusive, fully-paid, worldwide right and license to use, copy, perform, display, and distribute such information and Content and to prepare derivative works of, orincorporate into other works, such information and content, and to grant and authorize sublicenses of the foregoing.
3. You hereby agree that by virtue of being a member of Shagun Matrimonial, you may share or disclose the Content posted by you with Shagun Matrimonial, which may include personalinformation about yourself and your personal contact details, with or to other members of Shagun Matrimonial. You hereby agree, confirm and acknowledge that you will not hold Shagun Matrimonial or any of its employees, directors, agents,representatives and servants responsible or liable in any manner whatsoever from any losses, damages, costs, expenses orcharges that you may suffer as a result of the sharing or disclosing of your personal information or contact details with or to any other member(s) of Shagun Matrimonial or any other person whatsoever.

Member Disputes

You are solely responsible for your interactions with other Shagun Matrimonial members. Shagun Matrimonial reserves the right, but has no obligation, to monitor or settledisputes between you and other Members.

Privacy

Our Privacy Policy governs use of the Shagun Matrimonial service. By accepting this Terms of Use you are also hereby agreeing to adhere to our Privacy Policy.

Disclaimer

Shagun Matrimonial is not responsible for any incorrect or inaccurate Content posted on Shagun Matrimonial database or in connection with the Shagun Matrimonial Service, whether caused by Users, Members or by any of the equipment or programming associated with or utilized in the Service, nor for the conduct of any User and/or Member of the Shagun Matrimonial Service whether online or offline. Shagun Matrimonial assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communicationsline failure, theft or destruction or unauthorized access to, or alteration of, User and/or Member communications. Shagun Matrimonial is not responsible for any problems or technicalmalfunction of any telephone network or lines, computer on-line-systems, servers or providers, computer equipment, software, failure of email or players on account of technicalproblems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to Users and/or Members or to any other person's computerrelated to or resulting from participating or downloading materials in connection with the Shagun Matrimonial Site and/or in connection with the Shagun Matrimonial Service. Under no circumstances will Shagun Matrimonial be responsible for any loss or damage resulting from anyone's use of the Serviceand/or any Content posted on the Shagun Matrimonial Site or transmitted to Shagun Matrimonial Members. The exchange of matrimonial profile(s) through or by "Shagun Matrimonial" should not in any way be construed as any matrimonial offer and/or recommendation from/by Shagun Matrimonial. Shagun Matrimonial shall not be responsible for any loss or damage to any individual arising out of, or subsequent to, matrimonial relations established pursuant to the use of Shagun Matrimonial. The Services are provided "AS-IS" and Shagun Matrimonial expressly disclaims any warranty of fitness for a particular purpose or non-infringement. Shagun Matrimonial cannot guarantee and does not promise any specific results from use of the Shagun Matrimonial Service.

Limitation on Liability

: Except in jurisdictions where such provisions are restricted, in no event will Shagun Matrimonial be liable to you or any third person for any indirect,consequential, exemplary, incidental, special or punitive damages, including also lost profits arising from your use the Shagun Matrimonial Service, even if Shagun Matrimonial has been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, Shagun Matrimonial, liability to you for any cause whatsoever, and regardless of the form ofthe action, will at all times be limited to the amount paid, if any, by you to Shagun Matrimonial, for the Service during the term of membership.

Disputes

If there is any dispute about or involving the Site and/or the Service, by using the Site, you agree that the dispute will be governed by the laws of India without regard to itsconflict of law provisions. You agree to the exclusive jurisdiction of the courts of Delhi in respect of any matter arising out of or in relation to the Terms of Use for the Service or theSite.

Indemnity

You agree to indemnify and hold Shagun Matrimonial, its subsidiaries, affiliates, officers, agents, and other partners and employees, harmless from any loss, liability, claim,or demand, including reasonable attorney's fees, made by any third party due to or arising out of your use of the Service in violation of this Agreement and/or arising from a breachof these Terms of Use and/or any breach of your representations and warranties set forth above.

Others

• By becoming a Member of the Shagun Matrimonial service, you agree to receive certain specific content and promotional offers, via emails, phone, SMS, Whatsapp and direct mails from Shagun Matrimonial, its partners and affiliates. You can always manage your subscription to the content and offers using the My Account option.
• This Agreement, accepted upon use of the Site and further affirmed by becoming a Member of the Shagun Matrimonial service, contains the entire agreement between you and Shagun Matrimonial regarding the use of the Site and/or the Service. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect.

I HAVE READ THIS AGREEMENT AND HEREBY AGREE TO ALL OF THE PROVISIONS MENTIONED ABOVE.
